Now, let’s talk about those seven common mistakes that are likely standing between you and your completed Florida apostille—and how to avoid the delays, denials, and expensive do-overs that happen when the details are missed.
1. The Missing or Incorrect "Venue Statement"
This is the number one reason documents get kicked back. In Florida, every single notarized document must have a "Venue Statement" at the top of the notary block. It looks like this:
STATE OF FLORIDA
COUNTY OF [NAME OF COUNTY]
If your document was drafted by an attorney in another state or downloaded from a generic website, it might have the wrong county: or no venue at all. If a notary signs a document without a venue, the Secretary of State will reject it immediately.
How to Fix It: Before we sign, we always double-check that the venue reflects exactly where the notarization is taking place (for example, Sarasota or Charlotte County). If it’s missing, we ensure the correct language is added before the seal is pressed.
2. Using Outdated or Improper Notarial Language
Florida Statutes (specifically Chapter 117) are very specific about the wording a notary must use. Using a phrase like "Sworn and subscribed" when it should say "Acknowledged before me" can be the difference between success and a total restart.
Many people bring us documents with "pre-printed" notary blocks that haven't been updated in a decade. If the notary simply signs what’s on the page without checking if it meets current Florida standards, the apostille will fail.
How to Fix It: We stay up-to-date on every legislative change. If your document has outdated language, we can attach a "loose certificate" that contains the legally required wording to ensure the state accepts it.
3. The "Translation Trap" (Notarial Block in a Foreign Language)
If you are sending a document to a Spanish-speaking or French-speaking country, you might have the entire document translated. That’s great! However, Florida law requires the notarial certificate (the part the notary signs) to be in English.
The Secretary of State’s office in Tallahassee needs to be able to read and verify the notary’s act. If the notary signs a block written entirely in Spanish, it will be rejected.

4. Submitting a Photocopy Instead of a Certified Copy
This is a heartbreaking mistake because it’s so common. You cannot get an apostille on a photocopy of a birth certificate, death certificate, or marriage license. These are "Vital Records," and the state will only apostille an original, certified copy issued by the Department of Health or the Clerk of Court.
Similarly, if you’re apostilling a diploma or a school transcript, it must be an original document certified by the school registrar and notarized by a Florida notary.

5. DIY Remote Online Notarization (RON) Fails
In today’s world, Remote Online Notarization is a lifesaver. It allows US citizens in a Parisian cafe or a London office to get documents notarized for use back home. However, not every online notary is authorized to perform acts that will be accepted for a Florida apostille.
The state requires specific digital tampering-evident technology and a very specific type of digital seal. If you use a random online platform that doesn't follow Florida’s strict RON statutes, your apostille request will be denied.
How to Fix It: Work with a certified Florida online notary (like us!). We use state-approved, secure platforms that meet every requirement for a Florida apostille, ensuring your digital signature is just as valid as an ink one.
6. The "Smudge" and the "Oops": Seal and Signature Errors
It sounds simple, but you’d be surprised how often a notary seal is blurry, overlapping with text, or placed too close to the edge of the paper. Florida law requires the notary seal to be "photographically reproducible." If the seal is faint or the notary’s signature doesn't exactly match the name on their commission, the state will flag it.

Furthermore, some documents (like federal FBI background checks) cannot be apostilled by the state at all: they must go to the US Department of State in Washington, D.C.
